SOKA-BAU is the joint institution of the Tarifvertrag parties and administers the social fund procedures in the construction industry on the basis of generally binding collective agreements. It becomes relevant for construction companies when activities, locations of deployment and groups of employees fall under the relevant participation requirements. In that case, Gross pay, days of employment, holiday data, contribution rates and deadlines directly affect the monthly payroll run.
A clear classification shows the procedure as an interplay of notification, contribution, holiday logic and corrections. Particularly important in this regard are the differences between blue-collar workers, white-collar employees and trainees, as well as the tariff regions that continue to exist for social fund contributions.
The technical classification ranges from ULAK, ZVK and Collective agreement to registration data and deadlines, and on to typical misunderstandings in practical billing. The crucial factor remains the boundary between general auditing logic and a binding participation check in the specific business.
SOKA-BAU stands for the social funds of the construction industry. Behind this are procedures used to organise collective agreement entitlements and contributions in the construction sector. For employers, SOKA-BAU therefore forms a separate accounting and reporting environment within the Construction Payroll.
The holiday and wage compensation fund of the construction industry and the supplementary pension fund of the construction industry are joint institutions of the Tarifvertrag parties of the construction industry. These include, on the employers' side, the Central Association of the German Construction Industry and the Central Association of the German Construction Trade, among others, and on the employees' side, the IG BAU. No single Tarifvertrag party bears the procedure alone. As a social fund, the system therefore operates on the basis of collective agreements.
At its core, it is about three areas: holiday pay, supplementary pension and vocational training. These procedures are financed through contributions and put into practice in everyday Construction payroll life via notifications, employee data, gross wages and deadlines.
Direct classificationThe procedure becomes tangible for businesses above all when concrete notifications and contributions are generated from wage types, days of employment, holiday data and employee groups.
This distinguishes the procedure from a purely financial cost item. The procedures intervene in the monthly payroll run: data must be reported in full, contributions calculated correctly, holiday data maintained in a traceable manner and corrections cleanly followed up.
For the classification, the activities actually carried out, the place of work and the group of persons concerned are primarily relevant. The VTV forms a central collective bargaining framework for the social fund procedure.
For initial technical orientation, three levels of examination can be distinguished. They help to prevent the question from being prematurely reduced to a single term, such as a trade or industry designation.
| test level | Guiding question for the business | Meaning in Construction payroll | limit of the statement |
|---|---|---|---|
| Spatial | Are workers deployed on construction sites in Germany? | The place of work can determine whether the social fund procedure is applicable at all. | Postings and overseas construction sites require a separate assessment. |
| Operational | Do construction activities covered by the VTV predominate? | The main focus of the activity can turn a general industry question into a question regarding the social fund procedure. | A single trade is not enough for a conclusive assessment. |
| Personal | Which employee groups are affected? | The employee groups are not treated identically. | The exact classification depends on employment and role. |
| Binding clarification | Is there a business registration or participation check? | The billing cannot be set up reliably until the participation situation is clear. | A general technical classification does not replace a binding result for the individual case. |
Mixed businesses in particular should check their exact activity, operational structure and potential construction services. If a business provides finishing, assembly or craft services, for example, the precise activity can be more important than the familiar everyday designation.
No flat-rate obligationThe procedure must not be classified under Construction payroll according to the „build equals obligation“ model. The assessment only becomes reliable via participation requirements, main focus of activity, group of people and, if necessary, via a binding participation check.
The social fund procedure pools several procedures of the construction industry. For practical classification, three terms are particularly important: ULAK, ZVK and Collective agreement about the social fund procedure. They explain why the procedure in Construction payroll should not be understood as a single contribution.
ULAKThe holiday and wage compensation fund is relevant for Holiday entitlement, remuneration and reimbursement. It links periods of employment, holiday days and subsequent reimbursement by the fund.
ZVKThe supplementary pension fund represents supplementary pensions, construction trade union pensions and extra pensions. As a result, supplementary pension contributions can also appear as a separate specialist item in Construction payroll.
VTVThe Collective agreement regarding the social fund procedure forms an important basis for company classification, procedures, contributions and reporting obligations.
For the Billing of collective agreement principles in construction Is this separation useful: A Baulohn case can simultaneously affect holiday logic, supplementary pension, reporting data and contribution calculation. If only a part of this is considered, follow-up questions remain unresolved in the monthly run.
For practical purposes, therefore, it is not enough to look at just one fund. The institutions of the Tarifvertrag industries combine leave, pensions, vocational training and reporting obligations into a joint social fund procedure.
Vocational training also belongs in this context: in the construction industry, part of the training is organised inter-company and financed through the social fund procedure.
The monthly SOKA-BAU report relies on data that is generated within Construction payroll anyway, but must be correctly categorised there from a technical perspective. This mainly includes Gross pay, wage-paying hours, days of employment, days of leave, remuneration and hours of absence.
| Date of notification | Example in the monthly run | Why it is relevant | Typical consequence of an error |
|---|---|---|---|
| Gross wage | pay types, allowances, remuneration, back pay | For commercial employees, the contributory Gross pay forms the basis for calculating contributions. | Incorrect contribution basis and retroactive correction reports. |
| Hours payable | Working hours, paid periods, special accounting cases | The hours help to maintain comprehensible employment and claim data. | Unclear monthly report and queries regarding working or downtime hours. |
| working days | entry, exit, interruption, pro-rata monthly employment | They affect the temporal allocation in the social fund procedure. | Incorrect period allocation and unnecessary subsequent reconciliation. |
| Annual leave and remuneration | Accrued holiday with corresponding pay-out | The holiday logic links to reported holiday dates and remuneration. | Inconsistent holiday and reimbursement logic. |
| Cancelled lessons | weather conditions, illness, short-time working | Down time in construction can trigger specific consequential questions. | Lack of differentiation in the monthly return. |
A business that properly manages holiday days in the payroll system, but enters lost hours later, has a documentation and accounting problem. The correction can affect reports to the social insurance fund, contribution postings and internal monthly reconciliations. Also Surcharges in construction should therefore always be examined with regard to their role in the Bruttolohn logic.
For blue-collar employees, social fund contributions are calculated as a percentage of the Bruttolohn total. The contribution rate also continues to vary by collective wage agreement region. Despite harmonised collectively agreed wages, the contribution rates remain different according to the region.
Avoid mixing up east and westDifferent collective bargaining zones still exist for social fund contributions for manual workers. Anyone who applies general pay harmonisation in construction to social fund contributions is calculating the monthly payroll on a false assumption.
| fare zone | Total contribution for employees in the commercial sector | Stand notice |
|---|---|---|
| West | 19.8 % of the contributory Bruttolohn | From 01/07/2026 according to SOKA-BAU |
| East | 18.3 % of the contributory Bruttolohn | From 01/07/2026 according to SOKA-BAU |
| Berlin West | 25.25 % of the contributory Bruttolohn | From 01/07/2026 according to SOKA-BAU |
| Berlin East | 23.75 % of the contributory Bruttolohn | From 01/07/2026 according to SOKA-BAU |
Status of contribution rates as at 22/07/2026The collective bargaining parties agreed on the rates as of 01.07.2026. The declaration of general binding for the amendment had still been applied for on 22.07.2026. SOKA-BAU allows the application of the lower Urlaubskassenbeitrag as early as the July return.
The monthly return must be submitted by the 15th of the following month. Contribution payment is separate from this: social security fund contributions and, if applicable, the Winter employment levy must be paid by the 28th of the following month. This firmly embeds the procedure's deadlines into the construction payroll process.
The costs of Construction payroll are thus influenced by contribution rates, data quality and additional monthly effort. Subsequent reports, corrections, incomplete gross wages or incorrectly classified employee groups can also generate additional effort. Winter topics in construction should be kept professionally and cleanly separate from the holiday logic of the social funds, even if payment and reporting processes may coincide during the monthly run.
This holiday system is one of the reasons why the procedure is particularly practical in Construction payroll. In construction, holiday is a matter relevant to billing. For employees in the trade sector, periods of employment, reported gross wages, holiday days and holiday pay are interconnected.
A business that grants holiday must therefore record the absence and check the corresponding remuneration and reporting data. The paid remuneration, any holiday pay and the associated reporting data must also match the monthly report. If the employee takes holiday, the employer can have the corresponding benefit reimbursed via the Holiday pay fund.
Holiday datesGranted holiday days, remuneration and holiday pay belong in the monthly report and must match the Payroll.
refund logicMissing or corrected holiday dates can influence the subsequent reconciliation of entitlement, remuneration and reimbursement.
The practical consequence often only becomes apparent during a later change: if a day of holiday is corrected, remuneration adjusted or a period of employment added retrospectively, this affects the internal personnel file and may also affect the monthly return again.
Errors in procedural logic rarely stem from a single large calculation error. Frequently, they are incorrect assumptions regarding tariff zones, groups of people, registration data or deadlines. Such issues can generate back payments, queries or repeated rework during the monthly run.
| misunderstanding | Why problematic | Concrete consequence |
|---|---|---|
| „East and West no longer play a role in the contributions.“ | Tariff regions continue to exist for contribution rates of commercial employees. | Incorrect cost assumptions and inaccurate contribution planning. |
| „A trade is always exempt or always mandatory.“ | The actual focus of the activity and possible collective agreement exemptions are decisive. | Uncertain participation assessment and subsequent clarification work. |
| „All employees are registered equally.“ | Manual workers and other groups of employees follow different rationales. | False report, incorrect post or unnecessary follow-up questions. |
| „The report can be processed retrospectively after the payroll run.“ | The monthly report has a fixed deadline of the 15th of the following month. | remedial effort, estimates or delayed follow-up work. |
| „Payment and submission share the same deadline.“ | Notification and payment have different deadlines. | Deadlines calendar, liquidity planning and contribution account are drifting apart. |
These patterns belong to the concrete Sources of error in Construction payroll. It becomes particularly complex if a second return is required for the same month. In that case, the new return corrects the previously completed fields, and the business must be able to trace which wage change triggered which consequence in the social fund procedure.
Delayed payments may become subject to default interest, debt collection procedures and further steps after the due date. From a factual perspective, this is primarily a reminder not to treat reporting and payment as a secondary, subordinate task.
The procedure becomes particularly noticeable when businesses grow, employ several groups of employees, change construction sites or regularly generate adjustments in Construction payroll. With each additional special case, the importance of a clear professional classification increases.
Several employee groupsBlue-collar workers and other employee groups must not be lumped together into a common reporting logic.
Several construction sitesBye Construction payroll for multiple construction sites places of work, periods of employment and main duties are becoming quicker issues for audit and demarcation.
Subsequent changesWhen Gross pay, holiday or downtime are corrected, the monthly return may also be affected again.
Deadlines at the end of the monthReporting by the 15th and payment by the 28th require a different rhythm than internal approvals or later post-calculations.
The decision is made right at this point Payroll internal or external not abstract. It depends on whether a business can consistently and competently handle reporting data, deadlines, holiday data and corrections.
Secondment cases also fall into this risk zone, but should be considered separately. Operations by foreign construction companies in Germany or construction sites abroad by German companies can have their own connections to the social fund procedure without replacing the basic case of ongoing Construction payroll.
A robust classification begins with the question of which consequences actually arise in the specific course of the month: eligibility requirements, employee groups, contribution basis, holiday data, contribution rates, reporting, payment and possible corrections.
For the ongoing Construction payroll, a technical separation helps: the participation question belongs at the beginning, the employee groups in the master data logic, the liable Gross pay in the contribution basis, leave and periods of absence in the reporting data and the dates 15th/28th in the deadline calendar.
Practical orderFirst clarify the participation and validity logic, then properly manage employee groups, and afterwards check the reporting data and contribution rates in the monthly run. This makes the procedure visible in Construction payroll as a specialist sequence and not just as subsequent rework.
Such an order is not a general procedural cliché. It prevents concrete billing consequences: incorrect contribution expectations, missing holiday data, delayed reports, separate payment deadlines and correction reports without a discernible trigger.
